TDAUX recognizes and respect the original content, copyright, trademark owner’s right on such intellectual properties, at the same time requires third parties to respects TDAUX’s intellectual property right too. Abiding to Digital Millennium Copyright Act (DMCA), copyright infringement notification process is defined; a copyright owner or their authorized agent may submit a takedown request to our DMCA agent. As a SaaS service provider, we are entitled to claim immunity from said infringement claims pursuant to the “Safe Harbor” provision of the DMCA.

site or a Mobile Application, you can submit a good faith infringement claim in writing with

We at ‘TDAUX’ respond expeditiously to claims of any such infringement committed using our services, website or mobile application. TDAUX will take appropriate action, in it’s sole discretion, including but not limited to removing or taking down infringed content, repeated infringer’s user account or subscription may get suspended or terminated. TDAUX may give notice of such infringement complaint through general notice on our website, notification on mobile application, email or written communication.
if you opt to claim for content removal by submitting the claim, please note that it will initiate a legal process, any false claim or misuse of the legal provisions and process may result in the suspension or termination of your account/subscription. It may also create other legal consequences.
Retracting a Claim
In a case where copyright owner realizes, after submission of infringement claim, that either content is wrongly identified or feel that the content is lawfully used or change their mind regarding the claim, original claimant can submit a retraction request to our Copyright Agent with following details.
Counter Claim
If your listing on TDAUX is affected by such infringement claim and if you believe that claimed content is not infringing any copyright or any kind of intellectual property rights, or you have the authorization from the Intellectual Property Owner, or it’s agent, or pursuant to the law for posting or using such content, you may send a counter claim to the original copyright owner with a copy (cc) to our copyright agent with following details. Please note that we will only process retraction request submitted by original claimant of the copyright infringement. So upon receipt of your counter claim, if original claimant is satisfied he should submit retraction claim to TDAUX as mentioned above in this policy document. TDAUX will expeditiously act and restore the requested content at the earliest, upon receipt of such retraction request, after considering legal opinion on case-to-case basis.
